These Terms & Conditions (“Terms”) govern your use of the website, applications, and services operated by Tropical Ghar (“we,” “us,” “our”). By accessing or using our services, you agree to these Terms. If you do not agree, do not use our services.
1. Acceptance & changes
We may update these Terms at any time. The “Last updated” date above will change when we do. Continued use after changes constitutes acceptance. Material changes may also be communicated where practicable.
2. Accounts & eligibility
You must provide accurate registration information and keep your account secure. You are responsible for all activity under your account. We may suspend or terminate accounts that violate these Terms.
3. Marketplace — important disclaimer
The Marketplace is a platform where users may list or discover items and services offered by other users. Tropical Ghar is not a party to transactions between buyers and sellers, does not guarantee listings, quality, safety, legality, or delivery of any good or service, and does not employ or endorse sellers.
4. Prohibited conduct
You agree not to use our services to:
- Violate any applicable law or regulation;
- Defraud, harass, threaten, or harm others;
- List or promote illegal goods or services, or use the Marketplace for money laundering or other criminal activity;
- Misrepresent items or services, including fake, counterfeit, or materially misleading listings;
- Circumvent security, scrape or overload our systems, or impersonate any person or entity.
Enforcement: We may, without prior notice, remove content, restrict features, suspend, or permanently delete your account if we believe you have violated these Terms or the law. If your account is terminated for breach, any active paid subscription may be forfeited without refund, except where applicable law requires otherwise.
Fraudulent or false listings: Listing fake or materially misleading items or services may violate criminal or civil laws. We may preserve records and cooperate with law enforcement and courts as required or permitted by law. You are solely responsible for the truthfulness of your listings and communications.
5. Subscriptions & paid features
Certain features (including enhanced Marketplace capabilities) may require a paid subscription. By purchasing a subscription, you authorize us and our payment partners to charge the applicable fees.
- Fees, billing cycles, and included features are as shown at checkout or in your account at the time of purchase.
- Subscriptions may renew automatically where you have agreed to recurring billing, until you cancel according to the process we provide.
- Subscription fees are generally non-refundable except where required by law or as explicitly stated at purchase.
- We may change plans or pricing with reasonable notice where required; continued use after the effective date may constitute acceptance.
6. Payments & purchases (general)
Payments for our own products, subscriptions, or services are processed through third-party payment providers. You agree to their terms and our payment flows. You are responsible for providing valid payment information. Failed or disputed charges may result in suspension of access.
Taxes, if any, are your responsibility unless we state otherwise.
7. Custom tank orders — no refunds
Read carefully before submitting. Custom tank and bespoke build requests are made to your specifications. By placing a custom tank order, you confirm that you have reviewed all descriptions, dimensions, materials, timelines, pricing, and any other information we provide.
All custom tank orders are final. Tropical Ghar does not offer refunds on custom tank orders, including after work has begun, materials are ordered, or the order has been confirmed—except only where mandatory consumer law in your jurisdiction requires otherwise.
8. Messaging
In-app messages (including Marketplace-related messages) are processed through our systems. Message content is encrypted at rest using industry-standard encryption (AES-256-GCM) before storage. This protects data on our servers; it is not end-to-end encryption—our systems decrypt messages to display them to you and the recipient. We may access message content where necessary for safety, legal compliance, or enforcement of these Terms.
9. Intellectual property
Our name, logo, software, and content (excluding user-generated content) are owned by Tropical Ghar or licensors. You may not copy, modify, or exploit them without permission. You grant us a licence to host and display content you submit as needed to operate the service.
10. Disclaimer of warranties
Except where prohibited by law, our services are provided “as is” without warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant uninterrupted or error-free operation.
11. Limitation of liability
To the maximum extent permitted by law, Tropical Ghar and its affiliates, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the services or the Marketplace. Our total liability for any claim relating to the services shall not exceed the greater of (a) the amount you paid us for the service giving rise to the claim in the twelve (12) months before the claim, or (b) where applicable law does not permit such a cap, the minimum amount required by law.
12. Indemnity
You agree to indemnify and hold harmless Tropical Ghar from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the services, your listings, your violation of these Terms, or your violation of third-party rights.
13. Governing law
These Terms are governed by the laws applicable in the jurisdiction in which Tropical Ghar operates its business, without regard to conflict-of-law principles, subject to mandatory protections of your country of residence where they cannot be waived.
